Republicans are going to court to stop certain people who have never lived in New Jersey from voting in state elections.

The lawsuit is part of a broader push from the New Jersey GOP to shine a light on non-residents on the voter rolls. In June, state GOP Chairwoman Christine Giordano Hanlon said their Election Integrity Task Force found hundreds of non-citizens who were registered to vote. There were 30 documented cases of non-citizens casting ballots in elections, according to Hanlon.

New Jersey Republicans' investigation into non-residents on the state's voter rolls has caught the attention of national politicos. The Republican National Committee has joined the New Jersey Republican Party to sue the state.

Lawsuit targets New Jersey's overseas voting law

The lawsuit filed Thursday focuses on the state’s Overseas Residents Absentee Voting Law. It claims provisions passed in 2022 are unconstitutional. The amended law allows New Jersey residents' children born overseas who have not lived in the state to vote.

“Democrats are allowing certain people who have never lived in New Jersey to vote in the state’s elections. The RNC is taking them to court to stop this unconstitutional scheme, protect lawful voters, and secure New Jersey elections," RNC Chairman Joe Gruters said.

State says it will defend the law

The state has signaled it will fight the lawsuit.

“The right to vote is sacred, and Governor Sherrill and Attorney General Davenport will continue to ensure that eligible military and overseas voters are able to cast their ballots in our state’s elections,” Attorney General’s Office spokesperson Michael Symons said to the New Jersey Monitor.

State Department spokesperson Alicia D’Alessandro said she could not comment on active litigation.
